The former Futbol Club Barcelona (FCB) player, Dani Alves, recognized to vaginal penetration during a court session on the case of his alleged sexual assault, as his lawyer informed the Barcelona's provincial court on Thursday afternoon.

Martell acknowledged the intromission during a judicial session that had to decide whether the judge let the footballer leave custody, as he is currently in jail without bail.

The judge's decision is expected soon after Alves's attorney, Cristóbal Martell, acknowledged, for the first time, that his client vaginally penetrated the victim of the alleged sexual assault on December 30, last year, in the bathroom of Barcelona's Sutton nightclub.

The lawyer said that it was all consent, as if it had not been the case, the woman would have had injuries in her genital area.

The public prosecutor's office had completely opposed letting Alves free because of the "serious flight risk." For the attorney, the fact that he is from Brazil with a large net worth "allows him to ensure him to flee the country."

The defense proposed measures such as bail, passport confiscation, attending the courts regularly, and even wearing electronic tagging. However, the prosecutor's office believes these are not enough to ensure that the former FCB player is reachable by the Spanish judiciary system during the whole case.

Four different versions

Up to this moment, the player has given four versions of events regarding what happened that night. In his latest one, he claimed the woman had only voluntarily performed oral sex on him.

A few days later, a DNA test confirmed that the traces of semen found in the woman who accused footballer Dani Alves belonged to him

The test was also a positive match for evidence found on her dress, in her underwear, and on the VIP area bathroom floor.
