A year’s extension for Spain on its allotted time to meet the public deficit target has been deemed illegal by the lawyers at the European Council. This ruling comes after current Spanish President Mariano Rajoy sent a letter asking for an extension to the European Commission President Jean-Claude Juncker. A legal report to the Council was commissioned by the presidency of the Economic and Financial Affairs Council (Ecofin), after Germany’s complaints of having saved Mariano Rajoy from a sanction during the Spanish electoral campaign. However, the Ministers of Economy and Finance of the EU will not be able to approve this extra year until the European Commission decides whether or not it is punishable by a fine of up to 2 billion euros due to breach of the public deficit target. Despite the ruling, Spanish Deputy Prime Minister Soraya Sáenz de Santamaría has stated that there is “no doubt” that no fine will be issued for missing the deficit in 2015.

The draft budget for 2016 presented by Catalan Vice President and Catalan Minister for Economy and Tax Office, Oriol Junqueras, doesn’t have enough support to be passed by the Parliament. Although Junqueras described the budget as “realistic”and “socially committed”, pro-independence radical left CUP considered it insufficient and still too “autonomic”, and claimed that the draft didn’t “reflect the pro-independence declaration proposal”approved by the Catalan Chamber on the 9^th of November. Thus, CUP presented their veto and urged the Catalan Government to present a new draft which would include the anti-capitalists’ proposals, such as disobeying the deficit target imposed by the Spanish executive and carrying out a deeper reform of the tax system. Catalan President, Carles Puigdemont, warned that in order to “complete the task”and put Catalonia “at the gates of independence”the Parliament should at least be allowed to process the budget. This Friday, Puigdemont accused CUP of being “destroyers”if they continue to be carried along by “ideological prejudices”and maintain their veto on the bill.

Catalan President, Carles Puigdemont together with Catalan Vice President and Minister for Economy, Oriol Junqueras met this Wednesday with radical left pro-independence CUP MPs, Anna Gabriel and Joan Garriga in order to discuss their differences over the draft budget presented by the Catalan Government. Puigdemont and Junqueras refused to go back on the budget proposal for 2016 despite CUP’s veto. “If we want to complete our task, the Parliament has to process the budget”, stated Puigdemont during the plenary session this morning. He insisted that it is necessary to agree on the numbers in order to move forward. On the other hand, the anti-capitalists reaffirmed their position and insisted on their veto. The CUP MPs warned during their meeting with the Catalan Government that “it would be nonsense to put the draft to vote because it won’t go any forward” and emphasised that the present proposal leaves “no room for negotiation”.

There won’t be any agreement on the draft budget for 2016 unless the Catalan Government presents a new proposal including radical left CUP’s “proposals, demands and points of view”. This is what CUP MP, Eulàlia Reguant stated this Tuesday after registering theamendment to the entire budget proposal that the Catalan Vice President and Minister of Economy, Oriol Junqueras, presented last week. One of the anti-capitalists’ demands is to disobey the Spanish Government deficit targets and promote “more ambitious” tax reforms. On the other hand, the Catalan Secretary for Economy, Pere Aragonès warned that it’s “necessary” to pass the budget in order to put Catalonia “at the gates of independence”.

The first of three laws which will enable Catalonia to start the disconnection process from Spain has been registered this Tuesday. Pro-independence cross-party list ‘Junts Pel Sí’ and radical left CUP, which represent a majority of 72 pro-independence seats in the Catalan Parliament, registered the law for the creation of the Catalan Agency for Social Protection. Although the law represents a new structure, it is set to manage the current competences that the Catalan executive already has on this matter. Therefore, both parties admitted that the law is still “autonomic”. However, according to ‘Junts Pel Sí’ MP Chakir el Homrani “the Agency is necessary to manage the social security scheme, as happens in every country”.

The appeal presented in April by Spain’s executive calling for the suspension of some articles of the Catalan law against energy poverty has been accepted by the Spanish Constitutional Court (TC). In particular, the magistrates have cautionarily suspended 8 articles mainly oriented toward avoiding evictions. According to the TC, the suspension is automatic and therefore the magistrates “couldn’t do anything” but accept the Spanish government’s appeal. The Catalan Government’s Spokeswoman, Neus Munté, stated that this suspension was “to be expected”. The TC’s decision comes two days after thousands of people rallied in Barcelona to protest over the Spanish court’s measures against numerous laws passed by the Catalan Parliament. 

PSOE’s leader, Pedro Sánchez, proposed a “political agreement with Catalonia” which would be bilateral and in the context of the reform of the Spanish Constitution foreseen by the Spanish Socialists. According to PSOE’s candidate for Spanish President, this agreement would “recognise” Catalonia’s “singularity” and “improve its self-government” while always “respecting the implications of the principle of equality”. However, Sánchez didn’t specify whether this agreement would imply a new Statute of Autonomy for Catalonia. This bilateral agreement is one of the proposals in the document “Commitments for a ‘yes’ to the government of change” which PSOE presented this Monday. Another one is a possible reform of the funding scheme of the Autonomous Communities which would start in the next two months. 

The radical left CUP has decided to table an amendment to the entire draft budget that the Catalan Vice President and Minister of Economy, Oriol Junqueras, presented on Tuesday. Junqueras, however, said there is still time for “dialogue and negotiations” and told journalists that he hopes the new budget will be passed in Parliament and that there will be no need to extend the last one. The CUP, which has an agreement of parliamentary stability with Junts pel Sí, justified its veto on the budget saying that the proposal doesn’t reverse “privatisations and cuts” nor show “a clear and frontal disobedience” to the Spanish Government and the financial markets.

Marina Kaljurand said in an interview with CNA that the potential independence of Catalonia does “not really concern” Estonia, a country with no separatist movements. Kaljurand, a former diplomat, argued that any solution to the Catalan case “could be reached only by taking into account the existing laws and regulations and constitutions”, both nationally and internationally. “We have international law, the constitution and laws of each and every nation that have to be respected”, she stated. The minister said she has never received “pressure” or been “lobbied” by Spain or Catalonia and defined the Western position on the issue as “very clear, reasonable and balanced” as it supports “the present legal order”.

The Catalan President, Carles Puigdemont, regretted in a speech on Friday in Madrid that so far the Spanish political class has behaved as if it was “not concerned” by the pro-independence movement going on in Catalonia. Puigdemont urged the politicians that will need to form a new government in Spain to have “courage” in order to negotiate a referendum. According to him, “Catalans’ patience is not infinite”. “We won’t sit still with folded arms eternally”, he warned, asking Madrid to engage in “dialogue” with the Catalan administration. In another event, on Thursday in front of members of the business community, Puigdemont said that his government will never disobey the law while following the path towards independence. “I know that some people use the word ‘disobedience’. I won’t use it nor will my government”, said the Catalan President.

Catalan President, Carles Puigdemont celebrated the “consensus” that the construction of the Mediterranean Railway Corridor has amongst the political, social and economic agents in Catalonia and also amongst the regional governments involved in the construction, such as those of Valencia, the Balearic Islands and Murcia. However, he urged Spain’s executive “to listen” to their demands and also to Europe’s warnings and promote thislong-awaited piece of infrastructure which is set to transport freight and passengers non-stop from Gibraltar to Central Europe. Indeed, the European Court of Auditors reported on Tuesday that the EU “had not been effective in enhancing rail freight transport” and that the targets for “the number of freight trains and the tonnage of goods transported” on the section between Spain and France, which has still to be completed, “are far from being achieved”.

The Catalan Government’s total projected spending for 2016 amounts to €23.7 billion, 1.5% higher than last year’s bill and sets a deficit equivalent to 0.7% of Catalonia’s GDP, the same as that for 2015. Catalan Vice President and Minister for Economy Oriol Junqueras handed the proposal this Tuesday to the Parliament’s President, Carme Forcadell.According to Junqueras, the 2016 budget is “the most realistic and social-oriented budget ever”. After presenting the draft, Junqueras met with representatives of all the groups in the Parliament except for pro-independence radical left CUP. The anti-capitalist group, who have a ‘stability agreement’ with the governing party, declined the invitation in protest against the police baton charge that occurred this past Monday in Barcelona’s Gracia neighbourhood after the eviction of a social centre.

The Catalan Government’s budget for 2016 has been drafted and €700 million more is to be allocated to social spending compared to the budget of 2015, according to the Catalan Vice President and Minister for Economy Oriol Junqueras. He also stated that the Health sector will see an increase of €317 million, while the Education budget will increase by €211 million and that of Social Services will grow by €173 million. An additional 50 million more euros are to be allocated to the sectors of Universities and Research, stated the Catalan Vice President. The budget will be increased for the first time in many years, with the goal of being “realistic” and avoid “generating expectations that cannot be satisfied”. The budget will be delivered this Tuesday to Parliament’s President Carme Forcadell and opened for discussion amongst the groups in the Catalan Chamber.

Those supporters who carry pro-independence flags at the Copa del Rey final will be able to access the stadium. The judge of judiciary number 11 of Madrid accepted the appeal presented by lawyers' group 'Drets', which called for the “automatic suspension” of the Spanish government’s decision to ban the flags during the football match between FC Barcelona and Sevilla FC. Thus, according to the resolution, the cautionary measure requested by ‘Drets’ has been “partially estimated” and therefore “the execution of the appealed action is suspended”. The decision announced by the Spanish government’s Delegate in Madrid, Concepción Dancausa, triggered much criticism amongst civil society but also from most of the political parties. FC Barcelona also presented a lawsuit which is still being studied by another judge in Madrid

Former Catalan Minister for the Presidency, Frances Homs, is being investigated by Spain’s Supreme Court for helping to organise the 9-N symbolic vote on independence in 2014. Homs, who is currently the leader of Catalan coalition ‘Democràcia i Llibertat’ in the Spanish Parliament, is accused of disobedience, perversion of justice and misappropriation of public funds, the same charges for which former Catalan President Artur Mas, former Vice-President Joana Ortega and former Catalan Minister of Education Irene Rigau were also summonsed last October. Homs lamented the “low democratic quality” of the Spanish State and assured that he will testify before the court “carrying the pro-independence flag”.
