Barcelona High Court judge Santiago Vidal, along with a team of other law experts, has presented a proposal for a future Catalan Constitution in the event of independence with the aim to steer debate. The draft includes 97 articles according to which Catalonia would become a parliamentary republic with no army. However, this proposal can be changed as a webpage has been created through which citizens can table amendments online. Along with this draft, two other constitution projects have been presented: ‘constitucio.cat’ created by a team of Catalan law experts living abroad, and another constitution draft presented by ‘Lawyers for independence’ from the National Assembly of Catalonia (ANC). Spain’s Judicial Power Council (CGPJ) has called for the expulsion of Santiago Vidal from the Judiciary for his pro-independence initiatives.

After confessing that his family had kept a fortune in Andorra without informing tax authorities for 34 years, the President of the Catalan Government between 1980 and 2003 and founder of the centre-right Catalan nationalist coalition CiU, Jordi Pujol, his wife Marta Ferrussola and 3 of their 7 children (Marta, Mireia and Pere) testified before the judge investigating the case. They are indicted for alleged fiscal fraud and money laundering. During more than 2 hours, Pujol (aged 84) answered the judge’s and the anti-corruption public prosecutor’s questions. He insisted that his father had left a hand-written letter with instructions about 140 million pesetas secretly left in Andorra in 1980 for his wife and children, but not him, coming from his “illegal” activities selling currencies during the dictatorship. However, the defence has not yet presented any supporting documents. Besides this, 3 of Pujol’s other sons are indicted for other fiscal fraud and corruption cases.

The current President of the Catalan Government and leader of the centre-right pro-Catalan State coalition CiU, Artur Mas, will have to testify as a witness before the Catalan Parliament’s committee investigating the alleged fiscal fraud and possible corruption committed by the former Catalan President and CiU’s leader until 2003, Jordi Pujol. Artur Mas is Pujol’s political heir and was the ‘number 2’ in his last cabinet. Pujol, who uninterruptedly chaired the Catalan Executive between 1980 and 2003, confessed last July that his family had kept a fortune in Andorra for the last 34 years without informing tax authorities. The confession shocked Catalan society, since the historical leader of the conservative Catalan nationalists was a crucial figure in the fight against Franco’s dictatorship, the transition to democracy and the recovery of Catalonia’s self-government. Now, Pujol, his wife and 6 of their 7 children are being investigated by the judiciary for alleged fiscal fraud and several corruption scandals. 

The President of the Catalan Government, Artur Mas, assessed on Tuesday the Executive’s work during 2014, which he found to be “positive” overall, although he admitted there are still many people in great need and many social and economic challenges ahead. Referring to the current debate on whether to call early elections transformed into a ‘de facto’ referendum on independence from Spain, Mas promised immediate decisions to be announced on Thursday. Before taking the definitive decision and after weeks of admitted “confusion”, the Catalan President wants to hold a last round of talks with the main civil society organisations supporting independence and the left-wing pro-independence party ERC – with whom the governing centre-right pro-Catalan State coalition CiU has shared a parliamentary stability agreement for the last 2 years. “I will not slack” in the self-determination process, Mas stated.

“Unity gives us strength as a country”, stated Artur Mas, President of the Catalan Government, in the New Year’s official speech, which is broadcast annually on 30 December. Mas emphasised that “the [Spanish] State wants us to be divided”, because this way “we are weaker and more vulnerable”. The Catalan President makes this statement in the middle of the talks he is carrying out with the opposition left-wing independence party ERC in order to decide whether to run together in early elections that should be transformed into a ‘de facto’ independence referendum. However, the left-wing ERC is reluctant to run with Mas and members of the centre-right pro-Catalan State coalition CiU, which he leads. In his address, Mas also spoke in praise of the symbolic independence vote held on 9 November, which was “an exercise of democracy”, which “should call for dialogue and negotiation, instead of criminal prosecutions”.

The Spanish Government is carrying out “increased recentralisation” of powers, according to the President of the Catalan Government, Artur Mas, and that of the Basque Country, Íñigo Urkullu. Catalonia and Euskadi are the main stateless nations within Spain, with most of their citizens calling for greater levels of autonomy or full independence. They are Spain’s main industrial centres and combined they represent 25% of its GDP (€270 billion) and 20.5% of its population (9.7 million people). The President of the Generalitat and the Basque Lehendakari met on Sunday in Vitoria and agreed on “working together” to face the centralist and homogenising policies of the Spanish Prime Minister, Mariano Rajoy. In addition, they will also work to defend their nations’ right to self-determination.

Spain’s Director of the Public Prosecution Office, Eduardo Torres-Dulce, has announced his resignation “for personal reasons”. However, it is well-known that Torres-Dulce has had several arguments with the Spanish Government, run by the People’s Party (PP) and chaired by Mariano Rajoy. The latest argument was about prosecuting the Catalan President and other members of the Catalan Government for the symbolic vote on independence held on 9 November. Several PP members announced the penal actions before Torres-Dulce had given the instruction to press charges. At that time, Torres-Dulce denied having been pressured by the Spanish Government, but many voices criticised the absence of a separation of powers. On top of this, the main public prosecutors in Catalonia initially rejected the criminal complaint, but Torres-Dulce – appointed by the Spanish Government – obliged them to file it. Furthermore, he has also had many arguments with the PP on account of the numerous corruption scandals being investigated.

The President of the Left-Wing Catalan Independence Party ERC, Oriol Junqueras, has explained his own road map to allow citizens to vote on independence from Spain and build a new state. Junqueras proposed running in immediate early elections through different pro-independence lists with shared elements and opened to independents, in order to respect diversity. The ERC leader differed from the proposal of running through a single electoral list made by the President of the Catalan Government and leader of the centre-right pro-Catalan State coalition CiU, Artur Mas. Junqueras insisted on the need to answer to the social and economic concerns of many citizens in addition to those about independence. Should they altogether obtain a majority, the different pro-independence candidatures should form a national unity government and start building the new state from day one. He particularly emphasised the need to include those who did not voted for independence in the constituent process, which should be finally ratified in a referendum.

The Spanish Prime Minister, Mariano Rajoy, confirmed before the Senate that he had “not given any instruction to the Public Prosecution Office” to press charges against the President of the Catalan Government, Artur Mas, for having authorised and organised November 9’s symbolic vote on independence. Rajoy was answering a question from Mas’ party, the centre-right pro-Catalan State Coalition CiU, which had accused the Spanish PM of hiding behind the courts in order to avoid giving Catalan citizens a political answer regarding their self-determination demands. Besides, the CiU Senators showed banners in which they pleaded guilty for November 9’s vote as well. In the morning, the Catalan Government announced it will ask to testify before the court and to do it “en bloc”, if the criminal complaint from the Spanish Public Prosecution Office is accepted.

The President of the Catalan Government, Artur Mas, reacted on Thursday to the announcement that the Director of Spain’s Public Prosecutor Office will press charges against him and 2 other members of his cabinet for having authorised November 9’s symbolic vote on independence. Mas stated that “it is disappointing and pitiful” that the Spanish authorities’ reaction to the peaceful mobilisation of 2.3 million citizens is acting “though courts and prosecutors”. Despite the judicial complaint, Mas emphasised that Catalonia “will go on” with its “intentions, in a civic-minded, calm, democratic and firm way”. Besides, the Public Prosecutor Office’s show continued on Thursday, when the main prosecutor in Barcelona Province denied the fact that Catalan prosecutors were all against pressing charges against Mas. On top of this, she will try to re-open all the cases against Mas in relation to November 9’s vote. After this statement, Catalonia’s main prosecutor organised a meeting with the 4 provincial heads in order to set shared criteria regarding this issue.

After days of controversy, the Director of Spain's Public Prosecution Office, Eduardo Torres-Dulce, suggested that a judicial complaint against the President of the Catalan Government, Artur Mas, might not be filed because the case "is already at court". The People's Party (PP), which runs the Spanish Government, had announced that the Public Prosecution Office would file a complaint against Mas and some Catalan Ministers for having authorised November 9's symbolic vote on independence. Such an announcement seriously questions the separation of powers in Spain. On top of this, several Catalonia-based prosecutors protested over the Spanish Government's pressures. Torres-Dulce, who is appointed by the Spanish Government, decided to wait and meet on Wednesday with his delegate in Catalonia. They agreed to further analyse the case and make the decision in Catalonia. Such a legal step against Mas could provoke a boomerang effect against Madrid, mobilising a wide part of Catalonia's society.

As he announced on Tuesday, the President of the Catalan Government, Artur Mas, has begun a round of talks with the leaders of the parties that ran in the last Catalan elections supporting the right to self-determination. Mas aims to gather views and proposals about future scenarios and early elections. This includes the parties that backed the current self-determination process and the organisation of a consultation vote on November 9, by reaching an agreement in December 2013. But it also includes the Catalan Socialist Party (PSC), which ran in November 2012 backing a legal self-determination vote but whose previous and current leaderships do not back the current process. After the talks, Mas will take a few days to think, and very likely to talk again with some parties, and on November 24 he will announce his own road map for the next few months.

The President of the Catalan Government, Artur Mas, ruled out the consultation vote already called for the 9^th of November and agreed upon among a majority of Catalan parties, in face of the opposition from the Spanish authorities. However, he announced an alternative "participatory process" on that same day, in which 20,000 volunteers throughout Catalonia will run the polling stations, located in Catalan Government venues, and people would register just before voting. Mas believes that this new vote does not openly challenge the Spanish authorities' ban, while it is an alternative way to vote on the 9^th of November, as promised. However, he also admitted that such a process is not comparable to a proper referendum and stated that "the definitive referendum" would be early Catalan Parliament elections, where parties would transform it into a plebiscite on independence. The first reactions have been sceptical, both in Barcelona and Madrid.

Parties supporting the self-determination vote scheduled for the 9^th of November have met on Monday in Barcelona to discuss whether to carry on the consultation vote as is currently planned or to launch an alternative, in view of the total opposition from the Spanish authorities. According to two parties present at the meeting, the Catalan Government has ruled out the organisation of the consultation as it has been proposed by the decree that has been temporarily suspended by the Constitutional Court. Instead, the Catalan Government has proposed organising a “participatory process” on the same day, using the legislation that has not been suspended by the Spanish authorities. This alternative will be disclosed on Tuesday morning by the Catalan President, Artur Mas. The Spanish Government has already said it will also appeal against such an alternative. The left-wing Catalan independence party ERC has announced it will not back such an alternative and proposes a unilateral declaration of independence.

On Spain's National Day, the 12^th of October, the unionist association called Catalan Civil Society (SCC) organised a massive demonstration against Catalonia's self-determination and independence in downtown Barcelona, which was backed by the People's Party (PP) – running the Spanish Government, the anti-Catalan nationalist party Ciutadans (C's) and the Spanish nationalist party UPyD. It is the 3^rd consecutive year that a demonstration has been organised to support Spain's unity on the 12^th of October in the Catalan capital.  As happened on the two other occasions, organisers failed to fill up Catalunya Square although they gathered thousands of people carrying Spanish and Catalan flags. According to Barcelona's Police, 38,000 participated in it, while according to the Catalan Police 1.8 million people participated in the rally for the consultation vote and independence a month ago.
