The Spanish Constitutional Court (TC) accepted this Tuesday the suit presented by the Spanish Government which claimed that those line items in the 2017 Catalan budget oriented toward calling a referendum this September were illegal. The magistrates, which met in an extraordinary session to address only this matter, unanimously agreed to suspend these budget items for a period of 5 months, which could be extended if necessary. Rajoy’s Executive also wants Catalan President, Carles Puigdemont, and the other members of the Catalan Government to be personally notified of the suspension as well as the penal consequences of ignoring it. In particular, the TC suspended two line items: one establishes €5 million for electoral processes and €0.8 million for participation and the other refers to the possibility of calling a referendum with or without the Spanish State's permission.

85% of Catalans are in favour of a referendum on independence, according to a poll published on Sunday by the newspaper ‘El Periódico’. Of all the respondents, 49.6% approve holding a referendum without the Spanish Government’s permission and 35% make it subject to the support of the state. Only 13.8% of the respondents are totally opposed to it. Regarding the result of the vote, “yes” to Catalonia’s independence prevails with 48.9%, in comparison to 40.3% against. The media outlet published this Monday another poll in which it points out that, in case of elections in Catalonia, pro-independence forces would maintain or even increase their absolute majority in the Parliament with between 69 and 73 seats. Currently, the governing cross-party list ‘Junts pel Sí’ (JxSí) and the radical left pro-independence CUP total 72 MPs, with 68 needed for a majority.

The Spanish Constitutional Court (TC) suspension of the Parliament’s plan to call a referendum in Catalonia in September of next year has outraged many sectors of Catalan political and civil society. This Thursday, Catalan President, Carles Puigdemont, stated that the TC’s decision “confirmed” the existence of “constitutional populism” in Spain which claims that “Catalans are not allowed to vote”. In response, assured Puigdemont, the Government will simply “apply democracy”. “Catalans have the right to vote, debate and hold meetings, therefore, we will vote, debate and hold meetings”, he stated. The Catalan President also took the chance to express his support and that of the whole executive for the Parliament’s President, Carme Forcadell, who will face trial on Friday for allowing the pro-independence roadmap to be put to vote in the Catalan Chamber last July.

The Spanish Constitutional Court (TC) has temporarily suspended the proposal approved by governing cross-party list ‘Junts Pel Sí’ and radical left pro-independence CUP to call a referendum in Catalonia. The magistrates admitted this Wednesday to proceed with the appeal presented by the Spanish executive in October, which calls for the suspension of the pro-independence group’s proposal approved in the Parliament and considers it to have emerged from the previously suspended declaration to start launching the pro-independence roadmap. The TC judges have also warned Catalan President, Carles Puigdemont and Parliament’s President, Carme Forcadell that they must avoid any initiative aimed at contravening this suspension. The TC decision arrives only two days before Forcadell is due to testify before the Court for allegedly violating the Spanish Constitution when allowing the pro-independence debate to take place in the Catalan Chamber, last July. 

The Catalan President, Carles Puigdemont, has summoned the members of the National Alliance for the Right to Self-Determination to meet on the 23^rd of December to start organising the referendum on independence. The summit, in compliance with the resolutions adopted at the general policy debate in October, will be chaired by Puigdemont and the President of the Parliament, Carme Forcadell. As sources close to the presidency have told the Catalan News Agency, the meeting will be held in the Parliament just after it has given green light to the 2017 budget. The aim of the meeting is to find political and social consensus around the organisation of the referendum to be held next September 2017. According to the Spanish Government spokesman, Iñigo Méndez de Vigo, the meeting is a “symptom of unilateralism”, resulting from requests from “the radicals of the CUP”.

The pro-independence referendum in Catalonia, expected to take place in September next year, may be accelerated depending on Spain’s attitude towards Catalonia. “If the Spanish Government accelerates decisions against the Catalan institutions, we should find a solution somehow”, Catalan Vice President and Minister for Economy and Tax Office, Oriol Junqueras stated this Friday. In an interview with Catalunya Ràdio, Junqueras also admitted to “not having a clue” whether Spain’s executive will offer a political solution for Catalonia soon and lamented that the supposed willingness to dialogue expressed by the Spanish Government started by proceeding with the prosecution against Parliament’s President, Carme Forcadell, for allowing the Chamber to debate on independence.

The Government’s draft budget for 2017 presented to the Parliament's President, Carme Forcadell, this Tuesday includes an allocation of €5.8 million to guarantee that the pro-independence referendum scheduled for September will be carried out. In particular, the bill establishes €5 million for electoral processes and €0.8 million for participation. Moreover, the budget also includes hidden allocations which would allow the referendum to take place despite the inevitable suspension of the Spanish Constitutional Court (TC). In 2014, the budget also allocated €6 million oriented toward holding the 9-N symbolic vote in independence. At that time, the allocation was included within the Public Administrations department. However, this time the allocation would be an explicit competence of the Catalan Ministry for Economy and Tax Office. 

There will be an allocation in the 2017 budget for the pro-independence referendum, which the Catalan Government will carry out “regardless of the situation”. Thus, the Secretary for Tax Office, Lluís Salvadó, responded to pro-independence CUP’s demands to call a referendum in 2017 even if the Spanish Constitutional Court (TC) could ultimately appeal or suspend the bill. “The Catalan Government has a univocal commitment and the referendum will go ahead”, he stated this Tuesday in an interview with TV3. “We will do it in one context or another”, he added. The bill for 2017, which received CUP’s support last Saturday, also increases social expenditure by 989 MEUR in comparison to the amount allocated for this purpose in 2015. The Government is determined to approve the budget for 2017 and bring the bill before Parliament on the 29th of November.
