Left-wing Sumar to file complaint against top judicial figures over amnesty position

Sumar – the junior partner in the new Spanish coalition government – will file a complaint on Friday in the Supreme Court against senior judicial figures over their position on the amnesty for the Catalan pro-independence movement. 

The party, led by Spanish vice president Yolanda Díaz, accuse the president of the General Council of the Judiciary (CGPJ), Vicente Guilarte, and nine other members of the council of committing the crime of prevarication. In other words, that they issued a decision or pronouncement with the knowledge that it was unfair.   

On November 6, the CGPJ approved an institutional declaration against an amnesty for Catalan pro-independence figures. 

The text outlined the council's "intense concern" for the "degradation" of the rule of law in Spain with a potential amnesty. 

Sumar are critical of the fact that at the time the CGPJ took a position, the proposed law had not yet been registered in Congress or made public.
