The father accused of raping his daughter reached a deal on Wednesday with the prosecution teams to avoid prison time after violating a 200-meter restraining order.
The accused reached a deal to serve a four-month prison sentence. However, he will avoid jail time, as he has been convicted for less than two years, and he is not a repeat offender. He will not go to prison unless he commits another crime in the next two years.
In addition to the prison sentence, he is barred from approaching the victim within 200 meters or contacting her.
The man, aged 40 years old, was sent to court on Wednesday morning after violating the restraining order on Tuesday. He had recently been detained twice.
The father was arrested early on Sunday morning, accused of raping his 21-year-old daughter in Lleida, in western Catalonia. The events took place in Llotja Square, when some residents phoned the police after noticing two people engaging in sexual activity on the street.
Police officers confirmed they were the father and daughter. The woman said that her father was raping her and that it was not the first time.
Both were under the influence of alcohol, and with them was the victim's 8-year-old brother.
On Monday, neither the public nor private prosecutions requested that the man arrested be detained, so he was freed with charges.
The wife of the alleged perpetrator spoke to Catalan police, the Mossos d'Esquadra, on Tuesday to report that she had been the victim of sexual abuse by the man in her home country.
