Former Catalan President, Artur Mas, testified before the court this Monday for alleged disobedience and breach of trust for allowing the 9-N symbolic vote on independence in 2014. During his testimony, Mas insisted that the non-binding referendum “was not a personal whim or a last-minute idea” but “the consequence of wide parliamentary agreements and explicit and reiterated mandates of the Chamber”. Moreover, he emphasised that the 9-N "was unstoppable" since it was in the hands of volunteers rather than under the Government's control. Mas insisted that the 9-N took place “after democratic elections which nobody refuted nor questioned”. Mas refused to answer the Public Prosecutor’s questions after his testimony. Former Catalan vice-president, Joana Ortega and former Catalan Minister for Education, Irene Rigau have also declared before the judge.

More than 40,000 people filled Avinguda Lluís Companys in Barcelona this Monday in support of former Catalan President, Artur Mas, on his way to the Barcelona’s High Court. Mas faces trial for allowing the 9-N symbolic vote on independence to take place in 2014. Mas could face a 10-year ban from public office for putting out the ballot boxes and he is accused, together with former Catalan Ministers Irene Rigau and Joana Ortega, of “disobedience” and “breach of trust” as the Public Prosecutor believes that Mas, Ortega and Rigau “were fully aware” that by preparing the non-binding consultation “they were breaking the mandatory rulings of the Spanish Constitutional Court”.

Former Catalan President, Artur Mas, will have to testify before Barcelona’s High Court on Monday along with former vice-president Joana Ortega and former education minister Irene Rigau for allowing the 9-N symbolic vote on independence in 2014. In several appearances before the press this past Sunday, Mas insisted that he has “nothing to apologise for” and that the three whom have been summonsed face the trial “calmly and in good spirit” but also “moved and grateful for the people’s support”. “They wanted us on our knees, but they will find us standing”, he said. “It is a shameful trial, it is absolutely against democracy”, he said and pointed out that the “success of the 9-N and its high turnout” is what drove the case to the court. Mas, Ortega and Rigau are accused of criminal disobedience and breach of trust for holding the non-binding referendum and could receive a 10-year ban on holding public office if convicted.

The main pro-independence civil society organisations in Catalonia, the Catalan National Assembly (ANC), Òmnium Cultural, the Association of Municipalities for Independence (AMI) and the Catalan Association of Municipalities (ACM) have called for mobilisation once again. Under the motto ‘Love Democracy’ the associations aim to show the citizens’ support for former Catalan President, Artur Mas, who faces trial next Monday for allowing the 9-N symbolic vote on independence in 2014, together with former Catalan Ministers Joana Ortega and Irene Rigau. So far, nearly 30,000 people have joined the initiative and are expected to fill Barcelona’s Lluís Companys Avenue, where Catalonia’s Supreme Court is located and where the summonsed will have to testify for alleged disobedience and perversion of justice. 

Catalonia’s Public Prosecutor requested this Monday 10 years of ineligibility for public office for the former Catalan President, Artur Mas, for organising the 9-N symbolic vote on independence in 2014. Judges Francisco Bañeres and Emilio Sánchez Ulled also demanded a 9-year ban for the two other public figures summonsed over the same case, former Vice President Joana Ortega and former Catalan Minister for Education Irene Rigau. According to the judges, the three summonsed were “fully aware” that by preparing the non-binding consultation “they were breaking the mandatory rulings of the Spanish Constitutional Court” which urged the Catalan executive to stop the process four days before the 9-N took place. Mas considered the whole case “a chain of nonsense” and assured that “it is an honour to be sentenced by a Spanish State which doesn’t respect the separation of powers”.

Catalonia’s Supreme Court (TSJC) has dismissed this Thursday the appeals filed by former Catalan President Artur Mas, former Vice-President Joana Ortega and former Catalan Minister of Education Irene Rigau against their prosecution for alleged crimes of disobedience and administrative prevarication when organising the 9-N symbolic vote on independence. The Court magistrates believe that it is necessary to go on with the prosecution of the defendants for having authorised and co-organised the consultation, which took place on 9 November 2014. In its resolution, the TSJC insists on the “conscious resistance” of the three politicians to the Spanish Constitutional Court’s suspension of the participatory process. The resolution arrives three days before former Catalan Minister for Presidency, Francesc Homs, is due to testify in Madrid for the same cause.

Former Catalan President, Artur Mas, along with former Catalan Vice President, Joana Ortega and former Minister for Education, Irene Rigau won’t be accused for misappropriation of public funds in relation to the 9-N symbolic vote on independence. This is what the public prosecutor announced this Monday, after considering that the expenses related to the non-binding consultation were made before the suspension enacted by the Spanish Constitutional Court (TC). Nevertheless, the attorneys asked Catalonia’s Supreme Court (TSJC) to ignore the accused defences’ petition to file the case and summon the trio for the other crimes included in the lawsuit, which are alleged disobedience and perversion of justice.

Catalan President, Artur Mas, appeared this Thursday before the court, after being summonsed by Catalonia's Supreme Court for organising the 9-N symbolic vote in 2014. "The success and international impact of the 9-N consultation is what motivated this lawsuit" he stated "this summons responds to the Spanish Government's anger rather than legal reasons". Mas arrived at Barcelona's Courthouse by foot and was joined by the 400 Catalan mayors from the Association of Municipalities for Independence (AMI) and the entire Catalan Government. Right in front of the Court, thousands of people displaying Catalan flags rallied around the President and openly showed their opposition to Catalonia's Supreme Court's decision to summons Mas, which has been regarded as a political decision. Mas appeared before the court two days after Catalan Minister for Education Irene Rigau and former vice-president Joana Ortega and right after attending the commemorative events for the 75^th anniversary of President Companys' execution. 

Citizens all across Catalonia expressed their opposition to Catalonia's Supreme Court's decision to summons President Artur Mas, Catalan Minister for Education Irene Rigau and former vice-president Joana Ortega for organising the 9-N symbolic vote. This Tuesday, after Rigau and Ortega appeared before the court, thousands of people gathered together in front of their respective town halls, showing their support for the summonsed and declaring themselves guilty for participating in the 9-N consultation. The protests were organised by Alliance for the Right to Self-Determination of Catalonia ('Pacte Nacional pel Dret a Decidir'), a group of 1,500 institutions, political parties, trade unions, business organisations, professional associations, NGOs, cultural organisations and political pressure groups that support the celebration of a referendum in Catalonia. 

The first two public figures summonsed by Catalonia's Supreme Court for organising the 9-N symbolic vote on independence in 2014, Catalan Minister for Education, Irene Rigau, and former vice-president Joana Ortega, have appeared before the court today. Outside Barcelona Courthouse, around 500 citizens, brought together by civil society associations such as pro-independence Catalan National Assembly, showed their support for both of the summonsed and openly expressed their opposition to Catalonia's Supreme Court's decision, which has been regarded as a political judgment against Catalonia's right to decide its political future. Members of pro-independence unitary list 'Junts Pel Sí', liberal party CDC, left wing pro-independence party ERC, radical left CUP, Christian-democrat 'Unió' and alternative left coalition 'Catalunya Sí que es Pot' also took part in the protests, which are considered "a direct attack on justice's independence" by Catalonia's Supreme Court. 

Current Catalan President Artur Mas has been called to the court on the 15th of October for authorising and co-organising the 9-N symbolic referendum on independence that took place in 2014. Catalonia’s Supreme Court (TSJC), which pends on Spanish Administration of Justice, also confirmed the prosecution of former Vice-President Joana Ortega and Catalan Minister of Education Irene Rigau for the same charges. The official prosecution of Artur Mas and 2 other members of the Executive arrives two days after the 27-S elections and takes the current political conflict a level higher. The Catalan Government considered the TSJC decision a “democratic anomaly” and described it as a “political judgment”.

The Spanish Ministry of Education has filed an appeal to the Supreme Court of Catalonia (TSJC) to cancel the already-sent enrolment applications for the next school year in order to include the option of choosing Spanish as the language of tuition. Five parties representing 80% of the Catalan Parliament have strongly protested against this "new attack" on a school model that guarantees that pupils master both Spanish and Catalan and has many flexibility measures for newcomers. The model is also backed by an extremely broad majority of Catalan society and only a few dozen families, out of the 1.55 million pupils in Catalonia, had requested education in Spanish. Linguistic immersion in Catalan ensures knowledge of the language by children who are not regularly exposed to it, while the model also ensures knowledge of Spanish. Therefore, equal opportunities and complete bilingualism are ensured. However, the model has been the target of Spanish nationalists for a long time.

"We have to fight the same evils as the Enlightenment: obscurantism, fanaticism and tyranny", stated Consuelo Madrigal, the Director of Spain's Public Prosecution office – directly appointed by the Spanish Government – when  referring to Catalonia's self-determination process on Thursday in Madrid. Madrigal also added that the Spanish institutions and "the rule of law" have also to fight against the "deviations and errors" of the Catalan self-determination process. However, despite these strong words, she nuanced her statement by stressing something which should be obvious in any democratic country: she "will not prosecute intentions" such as the road map that pro-independence parties have agreed upon. Madrigal also referred to the prosecution launched against the President of the Catalan Government, Artur Mas, for the symbolic consultation vote on independence held on 9 November last.

The governments of Catalonia, the Basque Country, Andalusia, the Canary Islands and Asturias, which are the only Autonomous Communities that are not run by the governing People's Party (PP), have protested once again against yet another recentralising measure of the Spanish Executive that violates their exclusive powers on Education. The representatives of these 5 Autonomous Communities, which together represent almost 50% of Spain's population, left a meeting organised by the Spanish Minister for Education, José Ignacio Wert, held to present a new centralist and imposed measure in this field: from now on, the final exams of the obligatory education cycle and the baccalaureate (A-levels) will be drafted by the Spanish Government, which will make sure they are "homogenous" for the whole of Spain, as Wert said. Far from being anecdotal, the measure means subjects such as History of Catalonia, Catalan Geography and Catalan Language and Literature will not be included in the exams or will be treated as second-class subjects. 

In the annual Debate on the State of the Union in the Spanish Parliament, Prime Minister Mariano Rajoy repeated that he will “never” accept putting Spain’s unity in question. He said that the next Catalan Parliament elections, scheduled for 27 September, are not a ‘de facto’ referendum on independence, as pro-independence parties are claiming. However, Rajoy said he is willing to talk but only if “the law is always respected”. The Spokesperson of the centre-right pro-Catalan State coalition CiU, Josep Antoni Duran i Lleida, emphasised that “not making any proposal” to address Catalonia’s claims is “political negligence”. Furthermore, he regretted that the Spanish Government is not respecting the law when it is recentralising powers and not respecting Catalonia’s self-rule. The Spokesperson for the left-wing Catalan independence party ERC, Alfred Bosch, told Rajoy that “the sooner he acknowledges” that there is an independence referendum in September, “the sooner we will find solutions”.
