The Catalan Government will wait until dialogue expires before bringing Rajoy’s education decree to the Constitutional Court

On Tuesday the Catalan Council for Constitutional Guarantees (CGE) declared that the Spanish Government decree cutting €3 billion in education does not respect 2 Constitution articles and 5 other articles from Catalonia’s Statute of Autonomy, being thus unconstitutional and going beyond Madrid’s jurisdiction. The Catalan Government following the CGE’s unconstitutionality assessment decided to bring the education decree to the Constitutional Court(TC), as it did last week with Rajoy’s health decree. However, after the Spanish Government threatened to bring approved initiatives from the Catalan Executive to the TC, the Catalan Government decided to modify the decrees through dialogue and bring the decrees to the TC as a last option.

The Catalan Government will bring Rajoy’s health decree to the Constitutional Court

Following the advice of the Catalan Council for Constitutional Guarantees (CGE), the Catalan Executive will appeal the Spanish Government’s decree to save €7 billion in healthcare this year. However, it will continue implementing the decree until a judicial decision is made. According to the CGE, the decree violates 3 Spanish Constitution articles and 3 others from the Catalan Statute of Autonomy. The decree does not guarantee equality among all citizens, since it limits access to public healthcare. In addition, it invades the Catalan Government’s powers. Left-wing Catalan parties were the first to ask for CGE’s opinion, since they consider the new decree violates basic social rights.

Controversy surrounds Barcelona’s Immigrant Internment Centre after an intern’s death last January

The death of a Guinean intern in the Immigrant Internment Centre (CIE) in Barcelona last January, plus the recent prohibition by the Spanish Government’s Delegate in Catalonia to allow the Catalan Ombudsman to visit the facilities of the centre, a month ago, has increased the feeling of distrust towards this type of institutions where immigrants without their residence permit are preventively held until they are sent back to their original countries.

The Parliament approves the 2012 Spanish Government Budget without increasing investment in Catalonia

Using its absolute majority, the People’s Party (PP) has approved the Spanish Government’s budget for the current year refusing 3,100 amendments from the opposition. Only 3 minor amendments from the opposition parties have been accepted. The budget does not respect the current legislation, which obliges to guarantee a minimum investment percentage to be made in Catalonia in order to compensate for an historical lack of money being put into the Autonomous Community. According to Catalan law, approved by the Spanish Parliament, Catalonia should receive at least 18.66% of all the territorial investment made throughout Spain; however it only receives 11.04%.

The Catalan Minister for Business and Employment has praised the company as a model for innovation and internationalisation. He has spoke of the long tradition of the pharmaceutical industry in Catalonia as well as the Catalan economy’s export capacity.

Catalonia questions the constitutionality of the Spanish Government’s education and healthcare reforms

The Catalan Government has announced a plan against the Spanish Government’s “recentralisation offensive”. One of its actions is taking the education and healthcare reforms adopted by Madrid to the Catalan Council for Constitutional Guarantees, as a first step to bring them to Spain’s Constitutional Court. The Catalan Government believes that some of the measures invade its jurisdiction, as it directly manages education and healthcare. Another measure is issuing a report pointing out the Spanish Government’s duplicities, such as maintaining ministries such as education, healthcare and culture. These policies are managed by the Autonomies. Left-Wing opposition parties have urged the Catalan Government to take further measures, while the PP has accused the Catalan Executive of “lying”.

The French community in Catalonia takes a left turn

Last Sunday Socialist candidate François Hollande won the French presidential elections. After 17 years of conservative government the French voted for change including the French community of Catalonia, which had the possibility to express itself in 19 polling stations set up all around Catalonia. Between the first round of voting -two weeks ago- and the second round, the rate of electoral participation in Catalonia increased from 37,5% to 42%. The Franco-Catalan community came out strongly in favour of the Socialist candidate, with 52.79 % for Hollande as against the figure of 42.21% who voted for Sarkozy.

The Spanish Government doesn’t transfer the money, but transfers the blame

The Spanish Finance Minister, Cristóbal Montoro, blamed the Autonomies and town halls for Spain’s public deficit. Montoro stated that the Spanish Government is meeting the deficit objective for 2012 with the results from the first quarter. However, Catalan MPs reminded Montoro that he is refusing to pay the money it owes Catalan institutions and that with this strategy he transfers the blame for the deficit by not transferring the funds. The Catalan Government directly accused the Spanish Executive for their “massive lie”. According to internal studies from the Catalan Government, the Spanish Executive made incorrect calculations by saying the Autonomies could save €10 billion in healthcare and education with last week’s measures.

The Catalan Government keeps the drug prescription fee despite Madrid’s additional measures

The day after the Spanish Government imposed increasing the price citizens pay for medication, the Spokesperson for the Catalan Government confirmed that Catalonia will maintain the €1 drug prescription fee. The Catalan Health Minister had said earlier they would study if the drug prescription fee would be implemented. The main doctors union and Left-Wing opposition parties asked the Catalan Government to eliminate the drug prescription fee, because it would make Catalan citizens pay more for their medication than the rest of Spanish citizens.

High-Speed Train from Barcelona to France now delayed until the end of 2013

According to the Catalan Government, the High-Speed Train service linking the Catalan capital with the French border has been delayed one more year, this time until the end of 2013. The reason is that work on two sections of the railway, managed by the Spanish Government, is still pending to be allocated. They are the Barcelona exit and the section through Girona; both total €33 million according to the Catalan Government. The rest is already built and the service between the northern city of Figueres and the French city of Perpignan is already in operation. However, this strategic railway is not fully completed between Figueres and Barcelona due to a long list of delays.
